Standard Terms and Conditions of business
Our on-line portfolio pages need to meet standards which are treated as legal, decent, honest and truthful and should not contain anything which, as a matter of common sense, could be treated by normal people as objectionable material - including anything unlawful, defamatory, vulgar, pornographic, abusive, or in any way harmful to another person.
We expect our terms and conditions to be taken at face value. They are written in plain English and without reams of small print so that you will read them, understand them and then choose whether or not to accept them.
If you do not agree to these terms you may not use this Website.
"We" (and linked expressions) means London Photographic Awards Ltd
"You" (and linked expressions) means the person wishing to use the Website to present a portfolio of Work
"Work" means all the film, video, images, text and materials displayed on the Website and your Work means the Work shown in your portfolio pages.
"Website" means the www.lpa-movingpictures.com website.
Anything on the Website will be expected to comply with all applicable laws and regulations and in any communication through the Website you agree to use appropriate Netiquette as summarised under RFC 1855.
You will not do anything which is an abuse of the privilege granted to you to display your Works on the Website and you will act responsibly in the presentation of your Works.
Materials presented on the Website by you in any of your Works must belong to you and be your own original creation without copying all or part of another persons work. If any of your Works include work or materials belonging to someone else, or work in which someone else owns the trademark or other intellectual property rights, it is entirely up to you to obtain any licence or permission you might need to display that material.
You agree to indemnify us and hold us harmless against any costs, loss or expense we incur as a result of any claim, demand or other action being taken against us alleging that your Work infringes the rights of another person.
By presenting Work in your portfolio on the Website, you grant licence to us to display that Work in the normal way in which work is made available through the Website. It is your absolute responsibility to monitor your portfolio and its appearance on the Website, to make sure that works displayed in your portfolio comply with these terms and conditions and with the laws governing the use, publication or display of those types of Works.
Force Majeure or Disaster
We will try to make sure that the Website continues to be fully functioning and we will take reasonable precautions to protect the Website and Works which are displayed by you on the Website. If anything beyond our control stops us from being able to maintain the Website, and present your portfolio of Work, we will not be liable for any loss of business, direct or indirect losses, loss of any of the Works or down time caused by the problem. You will not use the Website as a storage facility for yourself and you will keep original and back up copies safe from harm in your own system.
If you do anything or allow anyone else to do anything in or to the Website which amounts to a breach of these terms and conditions, we will stop you using the Website immediately and your portfolio pages will be removed. Our decision on such matters is final.
We reserve the right to change our terms and conditions from time to time. If we make any changes then those changes will become effective immediately we have given you notice of the changes.
Notices to you will principally be given to you by sending you an email to the email address listed by you on the Website or by posting a general message on the Website. You agree that, as a user of the Website, it is your responsibility to maintain a valid email address to which notices can be sent and to check the Website from time to time to see if we have posted any general messages which might affect you.
We will not be liable to you for any direct or indirect loss or damage which you claim has arisen as a result of your using or not being able to use the Website including any damage which is caused by the unauthorised activities or interference of another person. You are responsible for and agree to take the steps which are reasonably necessary to provide you with protection from or insurance against any possible losses.
The terms and conditions shall be governed by and construed in accordance with English Law.
